1. Agreement to Terms

By inviting GohanBot to your Discord server, accessing our website at GohanBot.app, or using any of our services, you agree to be bound by these Terms of Service. If you are a server owner or administrator, you are responsible for informing your server members about these terms.

If you do not agree to these terms, please do not use our services and remove the bot from your Discord server.

2. Description of Service

GohanBot is an AI-powered Discord bot that provides:

• Real-time prediction market data and analysis from Polymarket
• AI-powered chat and market insights using Kimi K2.5 AI technology
• Twitter/X feed integration for tracked accounts
• Cryptocurrency price charts and market data
• GM/GN community engagement features
• Server management and analytics tools

3. User Responsibilities

You agree not to use GohanBot to:

• Violate Discord's Terms of Service or Community Guidelines
• Engage in any illegal activities or promote illegal content
• Harass, abuse, or harm other users
• Distribute spam, malware, or malicious content
• Attempt to exploit, hack, or reverse engineer the bot
• Use the service for financial advice - all market data is informational only
• Circumvent rate limits or abuse API resources

Violations may result in immediate termination of your access to our services without refund. If you witness any violations, please report them to support@GohanBot.app.

4. Intellectual Property

All content, features, and functionality of GohanBot, including but not limited to the bot code, website, designs, and documentation, are owned by GohanBot and are protected by international copyright, trademark, and other intellectual property laws.

You may use our services for personal and commercial Discord server use as intended. However, you may not:

• Copy, modify, or distribute our bot code or services
• Create derivative works based on our services
• Use our branding, logos, or trademarks without written permission
• Resell or redistribute access to our services

5. Subscriptions and Payments

5.1 Subscription Tiers

GohanBot offers the following subscription tiers:

• Free: Basic features with limited usage
• Basic ($9.99/month): Enhanced features and higher limits
• Pro ($29.99/month): Full access to all features and priority support

5.2 Payment Methods

We accept payments via:

• Credit/Debit cards (processed by Stripe)
• Cryptocurrency (USDC on Base network via x402 protocol)

5.3 Billing

Subscriptions are billed in advance on a recurring basis (monthly, quarterly, or yearly depending on your selection). Your subscription will automatically renew unless cancelled before the renewal date.

6. Refund Policy

Refunds are granted at our discretion and require valid justification. Eligible refund scenarios include:

• First-time payments within 24 hours of purchase
• Monthly subscriptions within 3 days of billing
• Quarterly subscriptions within 7 days of billing
• Annual subscriptions within 14 days of billing
• Major feature removal that significantly affects your purchased tier

Refunds will not be granted if:

• You have violated these Terms of Service
• Your access was terminated due to abuse
• You have already used a significant portion of your subscription period

To request a refund, contact us at support@GohanBot.app with your payment details and reason for the refund request.

7. Service Availability

GohanBot is provided on an "as-is" and "as-available" basis. We do not guarantee:

• Uninterrupted or error-free service availability
• That any specific features will be maintained indefinitely
• The accuracy, completeness, or reliability of any market data or AI responses
• That user data or configurations will be preserved indefinitely

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the service at any time
• Update pricing and features with reasonable notice
• Limit access to certain users or servers at our discretion
• Delete inactive accounts or data after extended periods of inactivity

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We are not responsible for any trading or investment decisions you make based on information provided by our service. Always do your own research and consult with qualified financial advisors.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GohanBot AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the service
• Any unauthorized access to or alteration of your data
• Any third-party content or conduct on the service
• Financial losses from trading decisions based on our data or AI responses

10. Third-Party Services

GohanBot integrates with various third-party services including:

• Discord - for bot functionality and user authentication
• Polymarket - for prediction market data
• OpenAI - for AI-powered chat features
• Twitter/X - for social media feed integration
• Stripe - for payment processing
• Coinbase/x402 - for cryptocurrency payments

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via our Discord support server or email (if provided). Your continued use of the service after changes are posted constitutes your acceptance of the modified terms.
